Terms of Service
The rules and conditions that apply when you book a speed boat diving day trip, PADI course or package with Manta Dive Komodo in Labuan Bajo, Indonesia.

These Terms of Service ("Terms") govern your use of services provided by PT Manta Dive Komodo ("Manta Dive Komodo", "we", "our", "us"), a company registered in Indonesia with offices at Jalan Soekarno Hatta, Labuan Bajo, NTT 86754, Indonesia.
By booking, paying for or participating in any of our diving day trips, PADI courses, dive-and-stay packages or related services, you agree to be bound by these Terms. If you do not agree, you must not book or participate.
2.Booking and Payment
How to book
Bookings can be made via our website, by email at info@mantadivekomodo.com, by WhatsApp, or directly at our office in Labuan Bajo. A booking is confirmed only once we send a written confirmation by email or WhatsApp.
Deposit and balance
To secure your booking, a 30% non-refundable deposit is payable at the time of confirmation. The remaining 70% balance is due before or on the day of the trip, before departure.
If the balance is not paid before departure, you forfeit your booking and the deposit. We reserve the right to refuse boarding in such cases.
Payment methods
We accept bank transfer, credit and debit cards (subject to fees), and cash in Indonesian Rupiah (IDR) at our office. Currency conversion is calculated at the prevailing rate on the day of payment.
Prices and inclusions
Prices include the items listed on each product page (typically: speed boat transfer, dives, equipment, lunch, water, Komodo National Park entrance fees). Anything not listed is excluded. Prices are subject to change without notice; the price quoted in your written booking confirmation is the price that applies to your booking.
3.Diver Requirements and Medical Declaration
Diving is a physical activity that carries inherent risks. To participate in our dive activities, you confirm that:
- For certified diver trips: you hold a valid certification from a recognised agency (PADI, SSI, NAUI, RAID, BSAC, CMAS or equivalent) and you can present your certification card on request.
- For PADI courses or Discover Scuba Diving: you meet the minimum age and prerequisites of the course (typically 10 years for Junior Open Water, 12 years for Open Water, 15 years for Advanced).
- You are in good health and able to dive. You will complete and sign the standard PADI Medical Statement before participating.
- If you answer "yes" to any condition on the medical statement, you must provide a written clearance to dive from a qualified physician dated within the last 12 months.
- You must not consume alcohol or recreational drugs before or during diving activities. We reserve the right to refuse participation if we suspect impairment.
- You must not dive within 18 hours before flying or ascending to altitude.
Failure to disclose a medical condition that affects your ability to dive safely may invalidate any insurance and remove our liability for related incidents.
4.Code of Conduct in Komodo National Park
Komodo National Park is a UNESCO World Heritage Site and a fragile marine ecosystem. By diving with us, you agree to follow these rules:
- Do not touch, chase, ride or harass any marine life — including manta rays, sharks, turtles and reef fish.
- Do not use flash photography on manta rays at cleaning stations.
- Maintain neutral buoyancy at all times. Do not stand, kneel or rest on the reef.
- Do not collect shells, corals, sand or any natural item from the park.
- Do not feed marine life under any circumstances.
- Follow all instructions from your dive guide and boat crew without exception.
- Respect Komodo National Park rangers and authorities. Park entrance fees are mandatory and included in your trip price unless stated otherwise.
Manta Dive Komodo operates as a registered tour operator under permits issued by Indonesian authorities. We follow Green Fins guidelines and reserve the right to terminate any dive if a participant repeatedly breaches these rules. No refund will be given in such cases.
5.Risk Acknowledgement
Scuba diving and snorkelling involve inherent risks including, but not limited to: drowning, decompression sickness, barotrauma, marine animal injuries, equipment failure, exposure (heat, cold, sun), seasickness, and physical exertion. By participating, you acknowledge and accept these risks.
You will be required to sign a standard PADI Liability Release and Assumption of Risk Form before your first dive activity with us. This is non-negotiable.
We strongly recommend purchasing dedicated diving insurance (such as DAN — Divers Alert Network) before your trip. Travel insurance that does not specifically cover scuba diving is usually insufficient.
6.Cancellation and Refunds
Our cancellation and refund policy is detailed in full on our Refund Policy page. The key principles are:
- The 30% deposit is non-refundable in case of customer cancellation, regardless of the reason or notice period.
- If the balance is not paid before departure, the booking is cancelled and the deposit is forfeited.
- If we cancel a trip due to weather, safety or force majeure, you receive a full refund or the option to reschedule.
- No-show or late arrival results in no refund.
7.Force Majeure
We are not liable for any failure or delay to perform our obligations caused by events beyond our reasonable control, including but not limited to: extreme weather, natural disasters (earthquake, tsunami, volcanic activity), Komodo National Park closures, government restrictions, port closures, civil unrest, pandemics, fuel shortages, or boat mechanical failure verified by the captain or harbour authority.
In such cases, we will offer to reschedule your trip within 12 months at no extra cost, or refund payments minus any irrecoverable third-party fees (such as park fees already paid to authorities).
8.Photos and Intellectual Property
Photos and videos taken by Manta Dive Komodo staff during trips remain the intellectual property of PT Manta Dive Komodo. We may use these for marketing on our website, social media and printed materials.
If you do not wish to appear in marketing content, please tell your guide before the trip and we will respect your preference. You can also request the removal of any image of you from our public channels at any time by emailing info@mantadivekomodo.com.
Photos shared with you (via WhatsApp, email or cloud transfer) are licensed for personal, non-commercial use. Commercial use, resale, or republication on stock photo platforms requires our written consent.
The Manta Dive Komodo name, logo, website content, copy, and brand identity are protected by copyright and trademark law. They may not be reproduced without permission.
9.Limitation of Liability
To the maximum extent permitted by Indonesian law, Manta Dive Komodo, its directors, employees, instructors, guides, boat crew and partners shall not be liable for any indirect, incidental, consequential or special damages arising from or in connection with our services.
Our total liability for any direct loss or damage arising out of or in connection with a booking shall not exceed the amount paid by the customer for that specific booking.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our gross negligence or wilful misconduct, or any liability that cannot be excluded under Indonesian law.
10.Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page shows the most recent version. The version of the Terms in force at the time of your booking applies to that booking.
For ongoing services, continued use after a change constitutes acceptance of the updated Terms.
11.Governing Law and Disputes
These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising out of or in connection with these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Manggarai Barat (West Manggarai), East Nusa Tenggara, Indonesia.
Before initiating legal action, both parties agree to attempt to resolve disputes amicably by direct communication. We are committed to dealing fairly and reasonably with any complaint.
